Please read these Terms of Service ("Terms") carefully before using the NEXIUM website (the "Website") operated by NEXIUM ("we," "us," or "our").
By accessing or using the Website, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree with any part of the Terms, please do not use the Website.
1.1. By accessing or using the Website, you confirm that you have read, understood, and accepted these Terms.
1.2. These Terms constitute a binding legal agreement between you and NEXIUM.
1.3. If you are under the age of 18, you may only use the Website with the permission and supervision of a parent or legal guardian, who agrees to these Terms on your behalf.
2.1. The Website is not intended for, and you may not use it if you are, under the age of 13.
2.2. You must provide accurate registration information and keep your account credentials confidential. You are responsible for all activity that occurs under your account, whether or not authorized by you.
2.3. You must notify us as soon as possible if you become aware of any unauthorized use of your account.
2.4. Accounts are personal to you and may not be sold, transferred, or shared.
3.1. You agree to use the Website in compliance with all applicable laws, including European Union regulations and national laws in your country of residence.
3.2. You must not use the Website to distribute unlawful, harmful, harassing, defamatory, hateful, or discriminatory content, including but not limited to NSFW content, hate speech, or content promoting violence or illegal activity.
3.3. Any activity that disrupts or harms the Website or other users (e.g., exploiting bugs, attempting unauthorized access, impersonating others, spamming, cheating, or denial-of-service attacks) is strictly prohibited.
3.4. We may use automated and manual moderation to detect violations of these Terms. Decisions to remove content, suspend, or terminate accounts are made or reviewed by us and are not solely automated.
4.1. NEXIUM is operated and hosted in the United States by American citizens. We value the principles of free expression reflected in the First Amendment to the United States Constitution, and within the bounds of Section 3 we aim to give users latitude to express unpopular, controversial, or dissenting opinions on the Website.
4.2. This does not extend to hate speech, harassment, or discriminatory content directed at any individual or group, including in particular LGBTQIA+ individuals, which remains strictly prohibited under Section 3.2 and will result in content removal and/or account action.
4.3. This section describes our general philosophy toward permissible speech on the Website. It does not override, and is subject to, the content restrictions set out in Section 3, and does not grant any right to post unlawful or otherwise prohibited content.
5.1. "Robux," "Tix," and any in-Website items, badges, or currency ("Virtual Items") are a limited license to access a feature of the Website. They are not real currency, have no monetary value, and are not redeemable for real money except where we expressly offer a paid exchange feature.
5.2. Virtual Items are not property, cannot be transferred outside the Website, and remain our property at all times. We may modify, suspend, or remove Virtual Items, or reset balances, at our discretion, including to correct exploits or errors.
5.3. We do not offer refunds for Virtual Items, whether obtained for free or purchased, except where required by applicable law.
6.1. Where the Website allows you to purchase Virtual Items, memberships, or other paid features, payments are processed by third-party payment processors (currently Cryptomus and Ko-fi). We do not store your full payment card or wallet details; please review the processor's own terms and privacy policy before paying.
6.2. All purchases are final and non-refundable except as required by applicable consumer protection law.
6.3. If you are an EU or UK consumer, you acknowledge that by requesting immediate access to digital content or Virtual Items after payment, you expressly consent to performance beginning immediately and, to the extent permitted by law, waive your statutory right of withdrawal once that performance has begun.
7.1. You remain the owner of any content you upload or share on the Website, but you grant us a non-exclusive, royalty-free, worldwide license to use, host, display, and distribute it for the purpose of providing and improving the Website.
7.2. You are solely responsible for the content you post, and you agree not to infringe upon the rights of others, including intellectual property and privacy rights.
7.3. If you believe content on the Website infringes your intellectual property rights, contact us at kaitlyn@chadthundercock.com with a description of the content, its location on the Website, and evidence of your ownership. We will review and, where appropriate, remove the content.
8.1. The Website, including its design, code, and all original content, is the property of NEXIUM and protected by copyright, trademark, and other laws.
8.2. You may not copy, reproduce, modify, distribute, or create derivative works based on the Website without prior written permission from us.
8.3. NEXIUM is an independent, fan-operated project and is not affiliated with, endorsed by, or sponsored by Roblox Corporation or any of its subsidiaries.
9.1. Your personal data is processed in accordance with the General Data Protection Regulation (GDPR) and, where applicable, the UK GDPR. Please review our Privacy Policy for details on what we collect, why, and for how long.
9.2. You have rights under the GDPR including access, rectification, erasure, restriction, portability, and objection regarding your personal data. See the Privacy Policy for how to exercise them.
10.1. The Website integrates with third-party services, including Discord (optional account linking), Cloudflare (security and bot protection), Google Analytics (usage analytics), and the payment processors listed in Section 6.
10.2. We are not responsible for the availability, content, or practices of these third-party services. Your use of them is governed by their own terms and privacy policies.
11.1. The Website is provided "as is" and "as available". We do not guarantee that the Website will be error-free, secure, or uninterrupted.
11.2. To the extent permitted by law, NEXIUM shall not be liable for any direct, indirect, incidental, or consequential damages arising out of your use of or inability to use the Website, including loss of Virtual Items or account data.
11.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for fraud or death or personal injury caused by negligence.
12.1. You agree to indemnify and hold harmless NEXIUM and its operators from any claims, losses, or liabilities resulting from your breach of these Terms or misuse of the Website.
13.1. We reserve the right to suspend or terminate your access to the Website at any time, with or without notice, if we believe you have violated these Terms.
13.2. We will notify you in advance of termination whenever possible, except in urgent cases such as security threats or illegal activity.
13.3. You may terminate your use of the Website, and request deletion of your account, at any time by contacting us as described in our Privacy Policy. Upon termination, your right to use the Website will cease immediately.
14.1. We may update these Terms from time to time. When we do, we will revise the "Last amended" date and, for material changes, notify users via the Website.
14.2. Continued use of the Website after changes take effect means you accept the updated Terms.
15.1. These Terms are governed by the laws of Poland and, where applicable, the European Union, without regard to conflict of law principles. This does not deprive you of the protection of any mandatory consumer protection provisions of the country in which you reside.
15.2. Any disputes arising under or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the competent courts of Poland, without prejudice to your right to bring proceedings in your country of residence where required by law.
15.3. If you are an EU consumer, you may also refer a dispute to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
16.1. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity of the remaining provisions.
